SAPO sends to court case against judges of Kyiv Court of Appeal

Four judges of the Kyiv Court of Appeal were found to have received a $35,000 bribe to lift the arrest of airplanes.

The SAPO has completed the investigation of the case against four judges of the Kyiv Court of Appeal who were caught receiving an undue benefit of USD 35 thousand. They received $35,000 for lifting the arrest from airplanes. This is reported by the SAPO press service, UNN reports.

Today, the NABU detectives, on behalf of the SAPO prosecutor, opened the case file to the defense for review.

The pre-trial investigation established that on November 28, an "intermediary judge" received an undue benefit from a representative of a private company for satisfying a complaint against a local court ruling to seize property, namely two airplanes.

After receiving the money, the judge kept USD 10 thousand. USD 10 thousand was kept for himself, and USD 25 thousand was transferred to his colleagues who had made the judgment. He transferred USD 25 thousand to his colleagues who had delivered the judgment. Subsequently, these funds were distributed among all members of the panel of judges who conducted the appeal.

During the searches at the judges' places of business and residence, detectives seized the funds received as an illegal benefit.

The actions of the judges were qualified under Part 3 of Article 28, Part 4 of Article 368 of the Criminal Code of Ukraine.

According to part one of Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and shall not be subjected to criminal punishment until his or her guilt is proved in accordance with the law and established by a court verdict of guilty.
