Verkhovna Rada plans to consider a draft law on combating domestic violence in the second reading

The Verkhovna Rada plans to consider in the second reading a draft law aimed at improving procedures for combating gender-based domestic violence in accordance with the Istanbul Convention.

At one of its upcoming meetings, the Verkhovna Rada plans to consider in the second reading draft law No. 8329 on amendments to the Code of Ukraine on Administrative Offenses in connection with the ratification of the Council of Europe Convention on preventing and combating violence against women and domestic violence (Istanbul Convention). UNN reports this with reference to the agenda of the Verkhovna Rada meeting.

Details

The purpose of the draft law is to ensure equal rights and opportunities for women and men in accordance with the provisions of the Council of Europe Convention on preventing and combating violence against women and domestic violence and to improve the procedural procedure for considering such cases.

The draft law proposes the introduction of certain tools aimed at building effective proceedings in cases of administrative offenses related to domestic and gender-based violence.

At the same time, the draft law introduces administrative liability for officials in case of failure to report domestic violence against a child and liability for sexual harassment.

Police officers are empowered to consider cases of administrative offenses related to the failure of a person subject to an urgent restraining order, according to which he or she must leave the place of joint residence (stay) with the affected person, to inform the authorized units of the National Police of Ukraine of his or her place of temporary residence, which will relieve the courts.

The amendments propose to increase to 24 hours the period of administrative detention of persons in cases of domestic violence, gender-based violence or failure to comply with an urgent restraining order, where necessary, to establish the identity or clarify the circumstances of the offense.

It is also proposed to increase the time limit for consideration of cases and set it accordingly, which will help ensure proper proceedings and the inevitability of bringing offenders to justice.

Addendum

In March of this year, the Committee on Humanitarian and Information Policy supported as a basis the European integration bill on improving the mechanism for preventing and combating domestic and gender-based violence.
